A Mumbai court granted bail on Monday to alleged kingpin of the kidney transplant racket Amit Kumar and his brother Jeevan Kumar after the police failed to file the chargesheet in the stipulated time of 90 days.
The Bandra metropolitan magistrate released the brothers on bail of Rs 15,000 each.
The magistrate also sent a show cause notice to the suburban Mahim police asking them to explain why they failed to file the chargesheet within 90 days of arrest.
The Mahim police will have to file its reply on September 23.
"We had filed for bail today as the 90-day period for filing the chargesheet ended on Sunday, Amit Kumar and Jeevan were arrested in this case on June 17 this year," advocate Ratnakar Singh, appearing for both them, told PTI.
Kumar was brought to Mumbai from Ambala in Haryana by Mumbai police in a case registered against him in May 2005 on the charge of duping a local into having his kidney removed.
Kumar and two others had allegedly promised Rs 3 lakh to the complainant and took him to Delhi and then to Gurgaon where the operation was conducted. However, in return the accused paid the complainant only Rs 70,000.
The second case against Kumar dates back to August 1994 when he was arrested for allegedly running a kidney racket from his clinic in suburban Khar.
