The prosecution on Monday submitted in a sessions court in Mumbai a list of charges it proposes to frame against actor Salman Khan, charged with killing one and injuring four persons in a hit-and-run case on September 28, 2002.
It justified its stand to try him with section 304 (culpable homicide not amounting to murder) -- a serious offence under the Indian Penal Code.
The court heard arguments on draft charges and deferred the matter for a further hearing on Tuesday. If the prosecution's plea is accepted, the court would frame charges against the actor or else the charges would be dropped.
Salman urged the court to drop the charge of section 304, which can be tried only by a sessions court. On other charges he did not raise any dispute.
The actor had allegedly rammed his vehicle into a bakery in suburban Bandra on September 28 killing one person and hurting three others who were sleeping outside.
He is charged with killing Noorulla Mahboob Sharif who was sleeping outside the bakery. The draft charges also book him under section 279 (rash and negligent driving).
The other proposed charges are section 338 (causing grievous hurt to 17-year-old Abdul Rauf Shaikh), section 337 (causing hurt to Kalim Mohammed Pathan and Munna Malai Khan by endangering their lives) and 427 (damaging property of bakery by dashing the car against its shutter).
The prosecution also proposes to charge the actor with section 134 (A)(B) read with section 187 of the Motor Vehicle Act, section 3 read with section 181 (driving without license) of the same act and section 185 (driving under the influence of liquor).
The draft charges also include section 66(i)(b) of the Bombay Prohibition Act.
