POTO withdrawn against Godhra accused

The Gujarat government on Friday decided not to invoke the Prevention of Terrorism Ordinance against the 28 people arrested in connection with the Godhra carnage, saying that the existing provisions under the Indian Penal Code were enough to proceed against them.

Chief Minister Narendra Modi said the decision was taken after the advocate general recommended that investigations could proceed as per IPC provisions.

The government had come under fire as those arrested in connection with the attack on the Sabarmati Express in Godhra were booked under POTO, but around 600 people named in the FIRs for the subsequent communal violence in the state were booked under other laws.

"Whether it is those arrested regarding Godhra carnage or in connection with the subsequent violence, action would be taken as per the IPC," Modi said.
