Fardeen was produced at the residence of Special Narcotic Judge M S Keny along with two other accused, Naseer Abdul Karim Sheikh and Tony Gomes, all of whom were picked up by NCB officers at Juhu in north west Bombay in the wee hours of Saturday and questioned for possessing nine grams of cocaine.
The trio was arrested later on Saturday night and detained in the NCB office at Ballard Pier in south Bombay throughout the night.
Fardeen, dressed in a navy blue shirt and jeans of the same colour, wearing black goggles, was brought by NCB officers, in a private car with police security, to the judge's residence near Metro cinema in south Bombay.
Reporters and camerapersons were not allowed to enter the residence of the judge. Later, defence advocate Ayaz Khan along with advocate Pradeep Hingorani told mediapersons that the actor was charged under Section 27 of NDPS Act.
Khan also said that Fardeen has been charged with consumption of the drug and not for dealing and peddling.
Usha Sisarya appeared on behalf of the prosecution and sought custody of the actor for further investigation.
Earlier, Fardeen was taken from the NCB office at Ballard Pier to St. George Hospital to undergo a medical test, in a private vehicle, before being produced before the judge.
Fardeen's father well-known actor-producer Feroz Khan came to the judge's residence accompanied by Kishen Kumar, brother of slain cassette king Gulshan Kumar.
Fardeen had been quizzed in detail at the NCB office throughout Saturday. NCB Deputy Director Ajay Ubale on Saturday night told reporters that the actor confessed that he had bought the cocaine from the two alleged drug peddlers for his personal consumption and also that he had been taking cocaine for the last four months.
Ubale said the NCB officers had laid a trap in Juhu acting on specific information about a drug deal. Fardeen arrived at the spot in his silver Opel Astra car and proceeded towards the HSBC ATM. However, his card got stuck in the machine.
In the meantime, one of the alleged drug peddlers arrived in a taxi and sat in Fardeen's car. The NCB sleuths swooped down on them when a deal was being struck between Fardeen and the alleged drug peddler in the car.
"Till we saw Fardeen, we were unaware about whom the Opel Astra belonged to," Ubale said.
