SC postpones TADA detenues' case till Wednesday

The Supreme Court on Tuesday put off the case of the 151 Terrorist And Disruptive Activities Prevention Act detenues till Wednesday after giving instructions to the Tamil Nadu government to produce the documents used by the public prosecutor while seeking the release of the detenues, in particular Radio Venkatesh, from a special TADA court.

Venkatesh is a close associate of sandalwood smuggler Veerapan and is an expert in explosives.

The three-judge bench also expressed its displeasure at the way the Karnataka and Tamil Nadu governments have handled the Dr Rajakumar kidnap crisis.

The court passed these orders after hearing the plea of Dr B L Wadhera, who had filed a special leave petition in the apex court on behalf of former director general of Tamil Nadu police Watler Devaram.

Wadhera said that while seeking the release of the dreaded TADA prisoners from jail, as demanded by Veerappan, Tamil Nadu government had not given any reason for their release.

If any special documents were indeed produced before the lower court, the same were not made available to the petitioner, Wadhera claimed.

Justice S P Bharucha, Justice D P Mahapatra and Justice Y K Sabarwal directed the state administration to produce the relevant documents before the court for its scrutiny.

On Tuesday, the court heard the arguments by Dr B L Wadhera and C Badrinath Babu, Abdul Karim's lawyer.

Abdul Karim, father of sub-inspector Shakeel Ahmed who was slain by Veerappan, was present in the court. He later told reporters that he had come all the way from Mysore to attend the hearing because the case against the TADA detenues had reached a crucial stage.
