City police may decide on Thackeray's arrest after PIL in Supreme Court on Friday

The Bombay police may decide its course of action in the Bal Thackeray case only after a petition on the Srikrishna Commission report is heard in the Supreme Court on Friday. The Maharashtra government had given the city police the go-ahead on Saturday to prosecute the Shiv Sena supremo for his articles in the party daily, Samna during the December 1992-January 1993 riots in Bombay.

The Samajwadi Party, the Congress and other organisations had filed a public interest litigation in the Supreme Court, asking for the Srikrishna Commission report to be implemented.

Majeed Memon, counsel for the Samajwadi Party, told rediff.com, "The petition coming up for hearing before the apex court deals with a complex question of law -- whether a state government is bound to act on the recommendations of a commission in cases where high ranking police officials and politicians are clearly indicted for serious criminal offences."

"This question needs the apex court's considered view. The issue of Shri Thackeray's arrest is not expected to be examined by the apex court on Friday in isolation, and therefore the outcome of Friday's proceedings may not have a direct effect on the controversy raging on the state," Memon, who is also the Samajwadi Party spokesman, added.
