The Rediff Special/Syed Firdaus AshrafBombay police procedure to identify and deport illegal aliensThe procedure followed by the Mumbai police in identifying and deporting foreigners residing illegally in the city: 1. The Beat Staff collects information about suspected foreigners. 2. The information is verified through confidential enquiries by the special branch. 3. The concerned special branch cell visits the place and asks the concerned suspect to show any of the following documents to enable the police to enquire about his national status. The documents are: a) Birth certificate b) School leaving certificate c) Ration card (d Electoral identity card and e) Domicile certificate. 4. Section 9 of the Foreigners' Act, 1946 puts the burden of proving the nationality on the suspect. In the event of failure to produce any such document to prove Indian nationality, the suspect is charged under section 3 (a), 6 (a) of Passport (Entry into India) Rule, 1950 r/w section 14 of the Foreigners' Act 1946 and produced before the Metropolitan Magistrate, 37th Court, Esplanade, Mumbai. 5. The court remands the suspect into police custody ranging from seven to 14 days. 6. During this period, if the people close to the suspect are unable to produce any of the above documents or proof of nationality, he is produced before the metropolitan magistrate after the expiry of remand. 7. The court is then moved by the police to permit deportation against the illegally residing foreigner. 8. On receipt of the court's permission to deport, the deputy commissioner of police, S B (I), C I D issues deportation order under section 3(2) (C) of the Foreigners' Act, 1946. 9. Bangladeshi deportees are sent with a police escort to the following post of the Border Security Force and handed over to them. Further deportation is completed by the BSF at any of the following check posts: Bangaon,) Krishna Nagar, Haridaspur, Seema Nagar, Kalyani or Sukhiya. Number of Bangladeshis deported since 1982:
